Court rejects application to halt Adu-Boahene trial as prosecution gains momentum

The Accra High Court has dismissed an application by lawyers for Kwabena Adu-Boahene, the former Director-General of the National Signals Bureau (NSB), seeking to suspend his ongoing criminal trial pending the outcome of an appeal.

In its ruling on Friday, October 17, 2025, the court refused to stay proceedings, meaning the trial will continue even as the appeal over an earlier disclosure dispute is heard.

The defence, led by Samuel Atta-Akyea, had requested the stay, arguing that the appeal concerned the denial of access to documents they claim are crucial to ensuring a fair trial. The team maintained that without those materials, the accused persons would be disadvantaged in mounting their defence.

However, the prosecution, represented by Deputy Attorney-General Dr. Justice Srem-Sai, opposed the motion, insisting the defence had failed to demonstrate any exceptional circumstances warranting a suspension of the case. He argued that the documents in question were either irrelevant or not within the possession of the prosecution, reiterating the basis for the court’s earlier refusal to compel further disclosure.

The High Court agreed with the prosecution, ruling that the pending appeal does not automatically suspend the trial and that proceedings must continue.

In a related twist, the Attorney-General, Dr. Dominic Ayine, earlier this week withdrew all charges against Mildred Donkor, the third accused person, under Section 59 of the Criminal and Other Offences (Procedure) Act, 1960 (Act 30), after she agreed to testify for the state.

The notice, filed at the High Court on October 15, indicated that Ms. Donkor will serve as a key prosecution witness, expected to shed light on a series of financial transactions involving Mr. Adu-Boahene, Angela Adjei Boateng (the 2nd accused and wife of the former NSB boss), and Advantage Solutions Limited.

The decision to discharge Ms. Donkor is seen as a strategic move to bolster the prosecution’s case as the trial enters a critical phase.

Mr. Adu-Boahene and his co-accused face multiple charges, including stealing, money laundering involving GH¢49.1 million, willfully causing financial loss to the state, and abuse of public office. Prosecutors allege that the accused persons diverted funds from state accounts to private entities for personal gain.

With the court’s latest decision, the high-profile case will proceed uninterrupted as the state continues to press its claims against the former intelligence chief and his associates.
