Minority demands Attorney-General’s resignation over GH¢350m flood relief controversy

The Minority Caucus in Parliament has called for the immediate resignation of the Attorney-General and Minister for Justice, Hon. Dominic Ayine, alleging constitutional breaches in the release of GH¢350 million approved for Ghana’s National Emergency Flood Response Programme.

The Caucus accused the government of bypassing constitutional and legal procedures in the disbursement of the emergency funds following the devastating floods that claimed 34 lives, displaced about 90,000 people, and affected seven regions.

Addressing a press conference in Accra on Wednesday, Deputy Minority Leader Patricia Appiagyei, alleged that a letter dated July 1, 2026, signed by the Attorney-General and addressed to the Governor of the Bank of Ghana, revealed that the Contingency Fund was already under garnishee proceedings when Parliament approved the emergency withdrawal.

According to the Caucus, the Attorney-General acknowledged in the letter that the fund was subject to court proceedings but advised the central bank to release the approved funds immediately in the interest of responding to the national emergency.

The Minority argued that if the Contingency Fund was under court attachment, the GH¢350 million could not have been lawfully withdrawn from that account unless the garnishee order had been lifted.

The Caucus questioned whether the funds were instead withdrawn from another public account without parliamentary approval, describing such a move as a potential violation of the Constitution and the Public Financial Management Act, 2016 (Act 921).

According to the Minority, Parliament specifically approved a withdrawal from the Contingency Fund and not from any alternative public account.

The Deputy Leader challenged the Ministry of Finance’s public announcement that the funds had been released from the Contingency Fund, demanding documentary evidence to support that claim.

Parliamentary inquiry

The Minority demanded the Attorney-General, Finance Minister and Governor of the Bank of Ghana appear before Parliament to explain the circumstances surrounding the release of the emergency funds.

The Caucus also called on the Auditor-General to undertake a special audit of the emergency flood response funds and submit a report to Parliament.

Patricia Appiagyei maintained that the Attorney-General had failed in his constitutional responsibilities by allegedly advising the central bank to proceed with the release of funds despite ongoing court proceedings.

She argued that any request to release the funds should have been made through the courts rather than through an administrative directive.

The Minority therefore called on the Attorney-General to resign immediately or be removed from office by President John Dramani Mahama.
