An Accra High Court has rejected the National Democratic Congress (NDC)’s objection to its authority to hear the New Patriotic Party’s (NPP) mandamus application.
The NPP is demanding that the Electoral Commission (EC) re-collate parliamentary election results in Okaikwei Central, Ablekuma North, Tema Central, and Techiman South, citing alleged errors in the initial collation.
The NDC argued that the NPP’s request was essentially an election petition disguised as a mandamus application.
They claimed that once results are declared, a mandamus order is no longer applicable.
However, the presiding judge dismissed this claim, ruling that the court had jurisdiction to conduct a judicial review and ensure the EC complied with the law.
This ruling clears the way for the court to hear the NPP’s substantive application for a mandamus order, despite the NDC’s insistence that re-collation is unnecessary since the results have already been declared.
